Jennifer Penberthy Buckley is an associate in Potter Anderson’s Litigation Group. Her practice focuses on employment counseling and litigation.
Jennifer advises employers on adopting and implementing effective policies consistent with federal and state law; responding to employee requests for leave and accommodation; avoiding and responding to discrimination claims; and more. Her employee benefits practice includes drafting and revising welfare benefit plans, deferred compensation and executive compensation plans, and Section 125 or “cafeteria” plans and “wrap” documents. Jennifer also counsels employers in drafting and negotiating enforceable employment agreements, restrictive covenants, retention agreements, and separation agreements.
In addition, Jennifer represents employers in proceedings before the Delaware Department of Labor (including the Unemployment Insurance Appeal Board), the EEOC, and Delaware federal and state courts. She also litigates contract disputes in Delaware state and federal courts.
After law school, Jennifer served as judicial law clerk for the Honorable Karen L. Valihura of the Supreme Court of Delaware. Prior to her legal career, she owned and operated a successful professional editing and proofreading business.
