Potter Anderson Counsel in Obtaining $60 Million Judgment and Injunction in Patent Infringement Suit November 19, 2008
Potter Anderson & Corroon partner Richard L. Horwitz and associate David E. Moore served as local counsel in a patent infringement suit brought by Becton Dickinson & Co. against Tyco Healthcare Group. The case involved Tyco's sale of Magellan safety needles, which incorporated a mechanism designed to prevent accidental needle sticks to health care workers. After a successful jury trial in the U.S. District Court for the District of Delaware, Chief Judge Gregory M. Sleet entered an order requiring Tyco to pay approximately $60 million in damages and prejudgment interest, and also entered an injunction with respect to the safety needles.
