Potter Anderson Secures Settlement for MPEG LA April 1, 2010
Potter Anderson & Corroon served as Delaware counsel, along with Sullivan & Cromwell, in the representation of MPEG LA in its suit against Alcatel-Lucent and Multimedia Patent Trust regarding certain patents that MPEG asserted should have been submitted to the MPEG licensing pool. After two days of a highly-watched trial in Delaware Chancery Court, the parties agreed to a settlement.
MPEG LA claimed in the suit that before their 2006 merger, Alcatel and Lucent schemed to transfer certain patents owned by Lucent to a trust (MPT) to avoid submitting them to the MPEG pool, which would have been for the benefit of MPEG licensees. The settlement requires MPT to submit the patents to MPEG LA, which will evaluate them to determine if they are subject to the pool as "essential patents" for MPEG-2 technology, and other consideration.
