Delaware Supreme Court Affirms Coverage Win for TIAA

The Delaware Supreme Court issued a decisive coverage victory for Teachers Insurance and Annuity Association of America (TIAA), securing more than $40 million in coverage from three insurance companies. The carriers had sought to overturn the Delaware Superior Court’s 2016 holding that TIAA’s costs in connection with underlying class actions constituted an insurable loss.

Serving as Delaware counsel to TIAA in collaboration with McKool Smith, partner Jennifer Wasson and associate Andrew Sauder led Potter Anderson’s representation in the Delaware Superior Court case and in the appeal.
