Intellectual Property

Potter Anderson & Corroon is well positioned to serve our client's business needs in regard to all aspects of intellectual property.

The firm's intellectual property practitioners render a variety of services relating to patents, trademarks and copyrights, including preparation and prosecution of patent and trademark applications in the United States Patent and Trademark Office and preparation of legal opinions regarding intellectual property rights.  We also negotiate and prepare licenses and other documents relating to the transfer of intellectual property rights, and perform IP due diligence and the monitoring of antitrust aspects of intellectual property transactions. Working with attorneys who practice in the tax area, our intellectual property practitioners also advise and counsel clients in the use of Delaware investment holding companies to hold intellectual property assets.

Potter Anderson & Corroon's IP Litigation practice is very active, which is not surprising because the United States District Court for the District of Delaware has more IP cases per judge than any other federal court in the United States.  We serve as local and lead counsel in a variety of intellectual property disputes, including patent, trademark, trade secret and copyright litigation.  We have worked with large and small companies – local, national and international – and have also served to coordinate efforts among large groups of parties in multiparty litigation.  We use our extensive expertise to meet the needs of the individual client in the context of the particular dispute – whether that means going to trial or negotiating a favorable business solution.

The firm's intellectual property practitioners are active in many local and national professional organizations relating to intellectual property law, including the intellectual property law sections of the Delaware State and American Bar Associations, and the American Intellectual Property Law Association, and the IP Advisory Committee of the United States District Court for the District of Delaware. The broad-based experience and professional activities of Potter Anderson & Corroon intellectual property attorneys enable us to address the growing needs of clients in this rapidly expanding area of the law.
