Potter Anderson Successful in Appeal on Behalf of GMG Capital

Potter Anderson & Corroon attorneys successfully appealed a Delaware Superior Court decision on behalf of GMG Capital Investments in a dispute over a remedy for a breach of contract. The Delaware Supreme Court reversed the Superior Court’s grant of summary judgment to Athenian Venture Partners, finding that GMG’s interpretation of the contract at issue was reasonable, rendering the contract ambiguous with respect to the remedy available in the event of a breach.  The Supreme Court also reversed an order awarding Athenian Venture Partners attorneys’ fees and costs in the action.  The matter was remanded to the Superior Court for further proceedings. The Potter Anderson team members were partners Michael Goldman and Timothy Dudderar.
