Potter Anderson Helps Secure $20.2 Verdict in Patent Infringement Case
Potter Anderson helped secure a significant jury verdict in the District of Delaware in a patent infringement case involving antibody technology. A jury found that Amgen Inc. and its subsidiary Teneobio Inc. willfully infringed a patent asserted by Harbour Antibodies BV and its partners, awarding $20.2 million in damages, which was the full amount sought.
The case focused on technology for developing human antibodies in rodents. Harbour alleged that Teneobio’s UniRat platform improperly used technology covered by Harbour’s patented Harbour Mice platform. After a week-long trial, the jury concluded that Amgen and Teneobio infringed the asserted patent claim under the doctrine of equivalents and rejected all invalidity challenges.
The jury also determined that the infringement was willful, reinforcing the strength of Harbour’s intellectual property rights and positioning the company to pursue enhanced damages. The verdict marks a strong outcome following several years of litigation.
