Barrist Presents on Loan Amendments for ABA Webinar

Joy Barrist participated in an American Bar Association panel titled “Loan Amendments: Borrower and Lender Beware!” on November 15. The webinar, sponsored by the ABA’s Section of Real Property, Trust and Estate Law, focused on aspects that borrowers and lenders should consider when amending a current loan. The presentation covered the following topics:

• Due Diligence — What additional due diligence should the parties consider?
• Drafting — The pitfalls and important considerations when negotiating and drafting loan amendment documents.
• Title Insurance — Is the current title insurance still good? What endorsements will you need?
• Opinion Letters — What additional opinion letters would the lender want and what can borrower's counsel provide?
