Choa and Palapura Weigh in on Delaware Patent Cases One Year After TC Heartland

In Law360’s article “Del. Faces IP Surge, Bench Gaps On TC Heartland's Birthday,” partners Jonathan Choa and Bindu Palapura commented on patent litigation in Delaware one year after the U.S. Supreme Court’s decision in TC Heartland LLC v. Kraft Food Group Brands LLC.

Referencing the Delaware District’s reputation as a litigation magnet long before TC Heartland, Choa stated, “We think it’s also a reflection on the strength of the court and the court’s reputation. It’s a well-respected court. It’s known as being even-handed.”

Addressing the judicial vacancies that has led the court to involve visiting judges, Palapura said, “We were lucky. We have some great judges from the Eastern District of Pennsylvania and Nebraska. From the standpoint of marshaling resources, I feel like our court also has done a really good job by using magistrate judges."
