Potter Anderson Helps Secure $12.2 Million Jury Award for Medical Device Client
A Delaware federal jury awarded $12.2 million to Potter Anderson client Lexion Medical, a Minnesota-based surgical device manufacturer, after finding a competitor liable for false advertising.
SurgiQuest, Inc., a subsidiary of CONMED Corporation, sued Lexion in Delaware federal court in 2014 for false advertising, deceptive trade practices and unfair competition in connection with products used in laparoscopic surgical procedures. The jury found Lexion not liable on all of SurgiQuest’s claims, awarding Lexion $10 million in punitive damages and $2.2 million in damages for lost profits.
