Aaron Stulman

Biography

Aaron H. Stulman is a partner in our Bankruptcy, Restructuring & Creditor’s Rights practice. For over a decade, he has counseled clients in a wide range of industries to navigate the distressed waters of insolvent companies, both in and out of court. He regularly represents debtors, official and ad hoc committees, secured lenders, liquidation trusts, asset purchasers, individual creditors and other significant stakeholders in chapter 11, chapter 7 and chapter 15 bankruptcy proceedings before the United States Bankruptcy Court for the District of Delaware. He also has extensive experience litigating in bankruptcy court, including prosecuting, defending, and mediating avoidance actions under chapter 5 of the Bankruptcy Code.

Bankruptcy clients are businesses in very difficult financial circumstances, either because they are in severe financial distress or they are in a business relationship with a company that is. In addition, their management finds themselves enmeshed in a completely unfamiliar, very technical legal and business process that will have a major impact on the enterprise for decades to come. In a sense, bankruptcy is the ultimate terra incognita for companies. Aaron sees his role as helping these clients make the very best out of a bad situation, often with surprisingly positive outcomes, particularly over the long term. An adeptly managed insolvency matter can be an excellent strategic decision for many clients, and a game-changer.

In this context, Aaron partners with co-counsel, GCs, CROs, financial advisors and other restructuring professionals to help his clients find the optimal path through the bankruptcy process. Depending on the client and the case, he may draft documents, initiate or defend litigation, argue motions or attend hearings, manage the day-to-day, negotiate with other parties or, perhaps most importantly, educate his clients in the legal and factual nuances of the bankruptcy process.

In addition to his knowledge of the law, Aaron offers his clients the benefit of deep familiarity with the Delaware bankruptcy ecosystem. Gathered from years of experience, Aaron has significant familiarity with the local practice and the Delaware bankruptcy judiciary, which gives him unique, invaluable insight. He can often anticipate how a judge may handle a factual or procedural issue, which adds immeasurable value for clients. He provides his clients with predictability in what seems like an unpredictable situation.

In his spare time, Aaron enjoys time with his wife and two young kids, plays golf when he can, and beaches at his family vacation house in Rehoboth Beach.
